This Privacy Policy (this “Privacy Policy”) describes how Chef Fei US Inc., a California corporation, and our affiliates and subsidiaries (collectively, “Chef Fei,” “we,” “us” or “our”) process personal information that we collect through our restaurants in the contiguous United States (including through kiosks and tablets), through our online properties or services that link to this Privacy Policy (including our website and mobile application), in connection with our marketing and social media activities, and through other activities described in this Privacy Policy (collectively, the “Service”).

 

Please read this policy carefully to understand our practices regarding your personal information.

DATA SECURITY

 

We take reasonable measures to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. These measures include physical, technical, and administrative safeguards. However, no data transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.  

 

DATA RETENTION

 

We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide you with the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. The specific retention period will depend on the type of personal information and the purposes for which it is processed.  

 

CHILDREN'S PRIVACY

 

Our Service is not directed to children under the age of 16, and we do not knowingly collect personal information from children under the age of 13 without verifiable parental consent, or children between the age of 13 (inclusive) and 16 (exclusive) without such childrens consent. If we learn that we have collected personal information from a child without such consent, we will take steps to delete it as soon as possible.

Depending on your state of residency, you may have certain rights related to your personal data, including:

Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.

Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information's nature and processing purpose.

Deletion. You may request that we delete personal data about you that we maintain, subject to certain exception under applicable law.

Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data "sales" as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Nevada provides its residents with a limited right to opt out of certain personal data sales. Nevada residents who wish to exercise their sale opt-out rights may submit a request by contacting us as described in the “Contact Us” section. However, please know we do not currently sell data triggering that statute's opt-out requirements.

While we do not typically receive monetary compensation for disclosing your personal information, under California law, “sale” can also include making personal information available to third parties for cross-context behavioral advertising. “Sharing” is defined as disclosing your personal information to third parties for cross-context behavioral advertising, even if no money is exchanged.

 

We may “sell” or “share” the following categories of personal information for cross-context behavioral advertising purposes:

· Right to Delete: You have the right to request the deletion of personal information that we have collected from you, subject to certain exceptions.  

· Right to Correct: You have the right to request the correction of inaccurate personal information that we maintain about you.  

· Right to Opt Out of Sale or Sharing: You have the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising.  

· Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to direct us to only use your sensitive personal information (e.g., precise geolocation, racial or ethnic origin, religious or philosophical beliefs, etc.) for limited purposes, such as providing the services you requested.

· Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights. This means we will not deny you goods or services, charge you different prices or rates, or provide you with a different level or quality of goods or services if you choose to exercise your rights.  

 

7. Exercising Your California Privacy Rights

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.  

 

The verifiable consumer request must:

 

· Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.  

· Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.  

 

We will try to respond to your request within 45 days of receiving a verifiable request. If we require more time, we will inform you of the reason and extension period in writing.  

 

8. Shine the Light

California Civil Code Section § 1798.83 permits users who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that were shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year.
